Ted Cruz Applauds SCOTUS for Overturning Chevron Decision

Supreme Court Ruling Shifts Power Back to Elected Officials

Senator Ted Cruz (R-TX) hailed the U.S. Supreme Court's recent decision to overturn the Chevron ruling, highlighting its significance in reducing the power of the administrative state. Cruz's comments came during the latest episode of his “Verdict” podcast, co-hosted with Ben Ferguson, as he discussed the Supreme Court’s 6-3 vote to overturn the landmark 1984 ruling in Chevron v. Natural Resources Defense Council.

Cruz explained, “The Chevron decision created something that is called ‘Chevron Deference.’ Now what is Chevron Deference? It was a doctrine that said the courts will defer to federal agencies on rules and regulations so long as that rule and regulation is, quote, ‘reasonable.’” He further elaborated on how this deference has allowed unelected bureaucrats to wield significant power over Americans' lives by issuing costly and harmful regulations.

  • Impact of Chevron Deference: Cruz detailed how the Chevron Doctrine led to the expansion of the administrative state, empowering bureaucrats to create regulations without accountability. This shift resulted in policies that were often burdensome to the American public.

  • Supreme Court’s Decision: By overturning Chevron, the Supreme Court has now ensured that policy decisions affecting Americans must be made by elected members of Congress rather than unelected bureaucrats. “The court last week overruled Chevron,” Cruz stated. “What that means now, is that it is Congress, it’s the elected members of Congress that have to make policy decisions that impact the American people, not the armies of bureaucrats who have no democratic accountability.”

  • Democratic Accountability: Cruz emphasized the importance of having elected officials, who are accountable to voters, making these decisions. He criticized Democrats and the media for their dismay over the ruling, arguing that they prefer decisions to be made by unelected entities that align with their political agendas. “They want unelected judges deciding so long as they agree with what the judges are deciding, and they want unelected bureaucrats deciding,” Cruz remarked.

The Supreme Court’s decision to overturn Chevron marks a significant shift towards restoring democratic accountability in policy-making, a move Cruz believes is crucial for protecting the Constitution and ensuring true democratic processes.
