Governor Newsom Signs Executive Order to Clear Homeless Camps in California

Governor Newsom calls for action following Supreme Court ruling, urging local officials to address the homelessness crisis.

California Governor Gavin Newsom has issued an executive order directing county and city officials to clean up homeless encampments across the state. This action follows a recent Supreme Court decision that grants cities more authority to address the growing homelessness crisis.

Newsom's order does not mandate cleanups but strongly advises local governments to take action. “The state has been hard at work to address this crisis on our streets,” Newsom stated. “There are simply no more excuses. It’s time for everyone to do their part.”

The Supreme Court's ruling last month allows cities to enforce bans on homeless individuals sleeping in public places, even when there is insufficient shelter space. The court found that such laws do not violate the Constitution’s prohibition on cruel and unusual punishment. The case originated in Grants Pass, Oregon, where the town attempted to fine people $295 for sleeping outside, leading to crowded public parks.

Prior to this decision, homeless encampments proliferated in California, Oregon, and Washington, with city officials limited in their ability to address the issue. Homeless individuals often refuse shelter beds, compounding the problem. Newsom's order now calls for state agencies to collaborate with local governments to provide housing and services for the homeless, rather than simply relocating them.

Since 2019, Newsom’s administration has invested approximately $24 billion into tackling homelessness. The Supreme Court ruling provides the definitive authority for state and local officials to clear unsafe encampments. Newsom emphasized that this decision “removes the legal ambiguities that have tied the hands of local officials for years,” allowing them to implement common-sense measures to protect community safety and well-being.

California has long struggled with homelessness, hosting the highest homeless population in the U.S. Approximately 180,000 people were homeless across the state last year, with about 123,000 unsheltered on any given night. In response, San Francisco Mayor London Breed announced plans to aggressively address encampments, as the city battles rampant homelessness, crime, and open-air drug use.

Homeless encampments have become so prevalent near freeways, under overpasses, and near exit ramps that California’s transportation department has developed protocols and designated workers to clear these areas.

Newsom's executive order represents a significant step in addressing the homelessness crisis, urging local officials to take immediate and decisive action. The success of this initiative will depend on the collaboration between state agencies and local governments to provide sustainable solutions for the homeless population.
