Trump Prosecution Called Election Interference by Missouri AG in Lawsuit Against New York
Lawsuit claims New York's actions violate First Amendment and federal election laws.
Missouri Attorney General Andrew Bailey has launched a lawsuit against the state of New York, accusing it of engaging in election interference through its prosecution of former President Donald Trump. Filed on Wednesday, the suit alleges that New York’s legal actions against Trump have significantly impacted the 2024 presidential election.
The lawsuit outlines three specific violations: interference with the presidential election in other states, infringement on voters' First Amendment rights, and contravention of a federal case prohibiting courts from sowing voter confusion or altering election rules. Bailey is urging the Supreme Court to intervene, claiming that New York’s restrictions on Trump’s campaign activities constitute unlawful election interference.
Key Points:
Sovereign Harm: The suit alleges New York's actions harm Missouri's 10 electors by undermining their federal authority.
Purcell Doctrine: Bailey references the Purcell principle, which advises judicial restraint in issuing rulings close to an election to prevent interference.
Campaign Restrictions: The lawsuit criticizes the gag order placed on Trump, arguing it limits his ability to campaign and could skew the election.
Bailey explained to The Daily Wire that the suit aims to protect Missouri's sovereign interest in participating in a national election on equal footing with other states. He emphasized that the uncertainty surrounding Trump’s eligibility, caused by Manhattan District Attorney Alvin Bragg, violates the Purcell doctrine and threatens the credibility of the election.
Bailey also addressed the gag order imposed by Judge Juan Merchan, Acting Justice of the New York State Supreme Court, arguing that the order and any potential sentencing should be postponed until after the election. He contends that while Trump’s conviction might be overturned on appeal, the campaign constraints imposed by New York could already influence the election outcome.
“Trump’s conviction is very likely to be overturned on appeal. But by then, the constraints New York has sought to impose on Trump to limit his ability to campaign will already have had their full effect,” Bailey explained. “Missouri has a strong, judicially enforceable interest in its citizens and electors being able to hear Trump’s campaigning free from any gag order.”
Bailey criticized what he perceives as the Left’s abandonment of fair play in favor of retaining power. “We used to live in a world where the rules of the game mattered about the players and the outcomes,” he said. “The Left has rejected that approach in favor of violating the rules in order to retain power because they’re so desperate to be in control and have authority, and they’re willing to sacrifice the rest of our rights on that altar.”
The lawsuit underscores the escalating legal and political battles surrounding the 2024 presidential election, highlighting concerns about the fairness and integrity of the electoral process.
