Pentagon Threatens Court-Martial for Senator Mark Kelly Over Illegal Orders Video
Democrat lawmaker under review for comments that could be prosecuted as seditious incitement under military law.

In an unprecedented escalation, the Department of War has launched a formal misconduct investigation into Democratic Sen. Mark Kelly of Arizona, signaling it may recall him to active duty for court-martial over a video urging U.S. troops to “refuse illegal orders.”
Kelly, a retired Navy captain and former astronaut, now faces potential prosecution under the Uniform Code of Military Justice (UCMJ) a move rarely taken against retired service members, let alone a sitting U.S. Senator.
The Pentagon made it clear Monday that Kelly’s rank and military retirement status make him subject to the UCMJ, and that his actions could fall under statutes prohibiting efforts to undermine troop loyalty and discipline.
“The Department of War reminds all individuals that military retirees remain subject to the UCMJ for applicable offenses,” the statement read. “A servicemember’s personal philosophy does not justify or excuse the disobedience of an otherwise lawful order.”
The Department cited 18 U.S.C. § 2387, a federal law against encouraging insubordination or disloyalty in the armed forces a law that carries serious criminal penalties, including confinement and forfeiture of pay.
Kelly’s now-infamous video, posted alongside five other far-left Democrats, was directed at U.S. troops and intelligence officers, warning. “Our laws are clear. You can refuse illegal orders.” Four of the co-signers are former military but not retired meaning only Kelly remains under active jurisdiction of military law.
Pentagon officials noted that Kelly’s use of his military rank in the video gave his statement the appearance of authority a dangerous move that could have real-world consequences among the ranks. As Secretary Pete Hegseth stated:
“Kelly’s conduct brings discredit upon the armed forces and will be addressed appropriately.”
Senator Kelly responded by claiming victimhood, posting on X that he won’t be “intimidated” and suggesting the investigation is politically motivated. Yet it's clear the law isn’t on his side. Courts have already upheld the military's authority to prosecute retired officers receiving pension benefits. In United States v. Dinger (2018) and United States v. Larrabee (2020), appellate courts affirmed that retirees remain subject to court-martial jurisdiction.
The move by the Pentagon isn’t political it’s constitutional. The military operates on strict discipline, and videos urging troops to reject orders from their commander-in-chief strike at the heart of national security.
President Donald Trump, responding to the video, didn’t mince words:
“SEDITIOUS BEHAVIOR, punishable by DEATH!”
And he’s not wrong. In a time of global instability, encouraging military insubordination from within the U.S. Senate is beyond reckless it’s potentially criminal.
White House press secretary Karoline Leavitt backed the investigation, stating:
“What Senator Mark Kelly was actually trying to do was intimidate the 1.3 million active duty service members.”
While Democrats spin this as free speech, no one is above the law especially not retired officers using their rank to question lawful military authority. There’s a legal line between disagreement and destabilization, and Senator Kelly may have just crossed it.
If the investigation proceeds, it could become the first court-martial of a sitting U.S. Senator in American history and rightly so.
