Special Counsel Jack Smith Steps Down from DOJ After Trump Cases

DOJ’s politically motivated cases collapse as Trump returns to the White House.

Jack Smith, the U.S. Special Counsel appointed to prosecute Donald Trump, has officially resigned from the Department of Justice after his cases against the former president collapsed. Smith’s departure comes as President-elect Trump prepares to return to office, marking the end of what many saw as a politically motivated legal campaign to stop him.

Smith’s resignation follows a massive legal defeat at the Supreme Court, which ruled in favor of Trump and reaffirmed that former presidents have significant immunity from prosecution for official acts. This decision effectively gutted Smith’s ability to move forward with his cases, leading him to drop them entirely.

From the start, Smith’s cases were viewed as an extension of the Biden administration’s weaponization of the Justice Department. Despite his insistence that the charges were legitimate, several key factors led to their downfall:

  • Supreme Court Ruling: The Court’s decision to grant Trump immunity for official acts destroyed Smith’s legal strategy.

  • Trump-Appointed Judges: Judges like Aileen Cannon exposed flaws in Smith’s cases, with Cannon even dismissing the classified documents case outright.

  • Legal Gridlock: Trump’s legal team successfully delayed proceedings long enough to prevent any verdict before the 2024 election.

With Trump’s victory, Smith was left with no choice but to step down, as DOJ policy prevents the prosecution of a sitting president.

Smith was appointed in November 2022 by Attorney General Merrick Garland, just as Trump announced his candidacy. His cases centered on the January 6 protests and Trump’s handling of classified documents charges Trump has always denied, calling them a desperate attempt by the political establishment to take him down.

Despite the media’s constant efforts to prop up Smith’s prosecutions, they ultimately failed to stop Trump’s momentum. Instead, they became a rallying cry for Trump’s supporters, who saw the indictments as clear election interference. Trump not only overcame these legal battles but used them to raise millions in campaign donations, solidifying his path back to the White House.

Smith’s resignation marks a turning point not just in Trump’s legal battles but in the broader fight against the weaponization of the justice system. No former president in U.S. history had ever been prosecuted before Smith, and now, with his resignation, it’s clear that this unprecedented effort to take down Trump has failed.

As Trump prepares to take office once again, the collapse of these cases serves as a stark reminder: the American people, not partisan prosecutors, decide who leads the country.
