GOP Secures Major Election Integrity Victory in Georgia
Supreme Court rules absentee ballots must be received by Election Day.
Republican National Committee Chairman Michael Whatley hailed a significant win for election integrity in Georgia after the state's Supreme Court ruled that absentee ballots received after Election Day will not be counted. The decision marks a critical moment in the GOP's ongoing fight to secure transparent and lawful elections.
“HUGE election integrity victory in Georgia,” Whatley declared on X, celebrating the Supreme Court's ruling. The GOP had swiftly appealed a lower court decision favoring the ACLU, which had sought to allow 3,000 late absentee ballots from Cobb County to be counted.

Supreme Court Ruling: Only absentee ballots received by 7:00 p.m. on Election Day will be counted. This ruling aligns with Georgia’s statutory deadline and ensures that Election Day remains decisive, not extended into the following days.
ACLU Lawsuit: The ACLU had argued for the inclusion of ballots postmarked by Election Day but received afterward due to administrative delays. However, the Supreme Court’s decision overturned a lower court ruling that would have permitted ballots to be counted until November 8.
This victory in Georgia isn’t an isolated case. The GOP also secured a favorable ruling in Mississippi, where a federal appeals court invalidated a law allowing mail-in ballots to be counted up to five days after Election Day. The court firmly stated that federal law mandates a single election day for casting and receiving ballots.
Circuit Judge Andrew Oldham wrote, “Federal law requires voters to take timely steps to vote by Election Day. And federal law does not permit the State of Mississippi to extend the period for voting by one day, five days, or 100 days.”
Michael Whatley praised both decisions as pivotal for maintaining the integrity of the electoral process. He emphasized that these rulings uphold commonsense ballot safeguards and reaffirm the legal standard that Election Day deadlines are non-negotiable.
