GOP Moves to Remove Obama-Appointed Judge Who Blocked Trump Deportations

Rep. Andy Biggs introduces bold resolution to bypass impeachment and hold activist judges accountable for overreach.

House Republicans are taking aim at yet another activist judge standing in the way of President Trump’s immigration agenda and this time, they’re doing it without waiting for a doomed impeachment vote.

Rep. Andy Biggs (R-AZ) introduced a resolution on Monday to remove Chief Judge James Boasberg of the U.S. District Court for the District of Columbia, citing “failure to maintain the standard of good behavior” as required under Article III of the Constitution.

Judge Boasberg, an Obama appointee with a history of political interference, recently blocked Trump’s administration from using deportation flights to remove suspected Venezuelan gang members under the Alien Enemies Act a move that sparked immediate backlash from the right.

“Judge Boasberg abused his judicial authority for political gain and is not in compliance with the constitutional Good Behavior Clause,” Biggs said. “He must not be permitted to remain in his position.”

Biggs’ new resolution offers a fresh strategy bypass the impeachment process entirely. While impeachment of federal judges requires a two-thirds vote in the Senate a near impossibility with today’s slim margins Biggs argues that Article III, Section 1 permits removal by the same process used to confirm a judge: a simple majority vote.

“Rogue judges may be removed the same way we confirm them by a simple majority,” he said.

While some in the GOP have long called for Boasberg’s impeachment, Biggs’ resolution opens the door to a more aggressive and achievable path for reining in judicial activism. He’s not alone President Trump and several conservatives have targeted judges who issue sweeping nationwide injunctions against presidential action, often in response to activist lawsuits.

Even as Chief Justice John Roberts tried to tamp down the movement with a rare statement defending the appellate process, House Republicans are forging ahead. On Wednesday, the House will vote on legislation to limit federal judges’ ability to issue nationwide injunctions a move aimed directly at curbing judicial overreach that has long hamstrung Trump’s efforts to secure the border and enforce federal law.

“We cannot stand by while activist judges... impose their own political agenda on the American people,” Biggs declared.

It’s a strong message from Republicans: the judiciary is not above accountability, and judges who weaponize the bench against the president and the Constitution will face consequences.
