Two Charges Against Trump Dismissed by Georgia Judge in Election Case

Trump secures another legal victory in controversial Fulton County indictment.

In a significant development in the legal battles facing former President Donald Trump, a Georgia judge dismissed two criminal charges against him on Thursday. Fulton County Judge Scott McAfee ruled that state prosecutors lacked the authority to pursue these charges, as a U.S. Supreme Court decision “preempts the State’s ability to prosecute perjury and false filings in a federal district court.”

Judge McAfee’s ruling quashed Counts 14, 15, and 27 from the indictment. While Count 14 involved other defendants, the two counts dismissed against Trump were Count 15, Conspiracy to commit filing false documents, and Count 27, Filing false documents. These charges were part of a larger indictment brought by District Attorney Fani Willis in August 2023, which has faced widespread controversy.

This latest ruling marks a victory for Trump and his legal team, as the former president has now defeated five of the original 13 charges levied against him in Fulton County. Trump’s attorney, Steve Sadow, expressed satisfaction with the court’s decision, stating, “President Trump and his legal team in Georgia have prevailed once again.”

Despite the dismissals, Trump still faces several serious charges, including violations of the Georgia RICO Act and conspiracy to commit forgery. However, with each legal victory, Trump’s defense continues to weaken the state’s case against him. The remaining charges include:

  • Count 1: Violation of the Georgia RICO Act

  • Count 9: Conspiracy to commit impersonating a public officer

  • Count 11: Conspiracy to commit forgery in the first degree

  • Count 13: Conspiracy to commit false statements and writings

  • Count 17: Conspiracy to commit forgery in the first degree

  • Count 19: Conspiracy to commit false statements and writings

  • Count 29: False statements and writings

  • Count 39: False statements and writings

With more charges still to fight, Trump's legal battles are far from over. Nonetheless, this latest ruling is another positive step for the former president as he continues to fend off what his supporters call a politically motivated indictment.
