France Releases Potential Charges Against Telegram CEO Pavel Durov

Durov faces serious allegations as French authorities investigate Telegram’s role in illicit activities.

French prosecutors have disclosed the potential criminal charges that Telegram founder and CEO Pavel Durov could face following his arrest last week when his private jet landed in France from Azerbaijan. The arrest has sparked widespread reactions, particularly from free speech advocates who view this as a potential crackdown on online expression.

The French Ministry of Justice stated that the investigation into Durov began in July, initiated by the Paris Public Prosecutor’s Office. The inquiry has now escalated into a full-blown investigation, with prosecutors listing twelve serious charges against Durov and his company, largely revolving around Telegram's alleged failure to moderate illicit content and its lack of cooperation with law enforcement.

The charges under investigation include:

  • Complicity in enabling illegal transactions: Accusations that Durov's platform facilitated organized crime by allowing illegal transactions.

  • Refusal to cooperate with authorities: Allegations that Durov refused to provide information necessary for legal interceptions.

  • Complicity in distributing child pornography: Serious charges involving the platform's alleged role in the distribution of pornographic images of minors.

  • Complicity in drug-related offenses: Claims that Telegram was used to facilitate the sale and distribution of narcotic substances.

  • Fraud and money laundering: Accusations of organized fraud and laundering proceeds from criminal activities.

  • Unlawful cryptology services: Charges related to providing unregistered cryptology tools that ensure confidentiality.

In France, investigative magistrates have significant authority to open investigations and charge individuals when there is sufficient evidence of criminal activity. Durov’s initial 24-hour detention period has been extended to 96 hours, meaning he could remain in custody until Wednesday as the investigation continues.

The arrest has ignited intense debate online, with many viewing it as an assault on digital freedom and free speech. In response to the growing controversy, French President Emmanuel Macron addressed the situation directly, stating on X that “false information” was circulating about Durov’s arrest. Macron emphasized that France remains committed to freedom of expression, innovation, and entrepreneurship but stressed that these freedoms operate within a legal framework designed to protect citizens.

“The arrest of the president of Telegram on French soil took place as part of an ongoing judicial investigation. It is in no way a political decision. It is up to the judges to rule on the matter,” Macron stated, underscoring the independence of the judiciary in enforcing the law.

As the legal proceedings unfold, Durov’s case could have significant implications for the future of online platforms and the balance between free speech and legal accountability. Stay informed by sharing this article and subscribing to our newsletter for updates on this developing story.
