Biden Advocates for Supreme Court Reforms Including Term Limits and Ethics Code

President Proposes Overhaul Amid Growing Criticism of Judicial Authority.

President Joe Biden is reportedly planning to push for significant reforms to the Supreme Court, following years of criticism and challenges to its authority. According to The Washington Post, Biden intends to endorse term limits for justices and enact an enforceable code of ethics for the Court.

Biden's proposed changes may include other reforms and a potential push for a constitutional amendment to remove broad immunity for constitutional officeholders, such as Supreme Court justices and the president. The left wing of the Democratic Party has been pressuring Biden to address the Supreme Court, especially after its decisions to overturn Roe v. Wade and rule on presidential immunity.

“I’m going to need your help on the Supreme Court, because I’m about to come out — I don’t want to prematurely announce it — but I’m about to come out with a major initiative on limiting the court … I’ve been working with constitutional scholars for the last three months, and I need some help,” Biden told the Congressional Progressive Caucus in a call over the weekend, as reported by The Washington Post.

The feasibility of these changes remains uncertain, as they would likely require congressional approval. With Republicans controlling the House of Representatives, even by a thin margin, passing such reforms could prove challenging.

Biden has recently criticized the Supreme Court for being "out of touch with what the founders intended," particularly after a ruling that granted some immunity to former President Donald Trump for actions taken while in office. Biden called the ruling a “terrible decision” in an interview with NBC’s Lester Holt and expressed his disapproval during a public address, stating, “I dissent.”

“This nation was founded on the principle that there are no kings in America; each of us is equal before the law,” Biden said. He argued that the decision sets a “dangerous precedent, because the power of the office will no longer be constrained by the law.”

Experts suggest that Biden's increasing attacks on the legitimacy of the Court are detrimental to American politics. Kyle Brosnan, chief counsel for the Heritage Foundation’s Oversight Project, described Biden's behavior as unprecedented.

“I see President Biden’s statements as another datapoint in a years-long crusade by the left to delegitimize the Supreme Court because they don’t like their rulings,” Brosnan said. He added that the Trump immunity decision is a win for the presidency, suggesting that Biden should celebrate his likely insulation from facing potential charges for allegedly weaponizing the Justice Department against political enemies.

Biden’s planned reforms signal a significant shift in how the Supreme Court may operate in the future, with potential implications for the balance of power and the integrity of the judicial system.
