350,000 Asylum Claims Canceled by Biden Administration, Sparking Mass Amnesty Debate

Investigation reveals the Biden administration's controversial move to indefinitely allow migrants to stay in the U.S.

The Biden administration has canceled over 350,000 asylum cases, effectively allowing these migrants to remain in the United States indefinitely. Experts are calling this a move towards "mass amnesty."

  • An investigation by the New York Post revealed that since 2022, more than 350,000 asylum cases were terminated without a decision on their merits.

  • Migrants whose cases were dismissed neither received nor were denied asylum but are now able to stay in the U.S. indefinitely.

  • These individuals are not required to check in with authorities and have effectively been removed from the legal system.

Kerry Doyle, the Immigration and Customs Enforcement’s Principal Legal Advisor, issued a memo in 2022 instructing prosecutors to allow for the dismissal of these cases. Andrew Arthur, a former immigration judge and current Resident Fellow at the Center for Immigration Studies, described this as "mass amnesty under the guise of prosecutorial discretion," allowing individuals without legal status to remain in the country indefinitely.

The report also highlighted that 77% of those who applied for asylum under the Biden administration have been permitted to stay in the U.S. This leniency comes amid a staggering asylum backlog of over 3.5 million cases.

The consequences of this policy are far-reaching. Individuals with terminated asylum cases can reapply for asylum or wait for potential pathways to citizenship, such as mass amnesty, which some Democrats are advocating for.

This revelation coincides with a significant crisis at both the southern and northern U.S. borders. There have been over 9.5 million nationwide encounters and an estimated 1.7 million illegal immigrant gotaways under Biden's leadership. Additionally, the U.S. foreign-born population has reached a record 51.6 million, driven largely by illegal immigration.

Biden’s handling of immigration is becoming a critical issue as the 2024 elections approach. Polls indicate that only 20% of voters believe the U.S. has control over its borders, and Americans generally trust former President Donald Trump more than Biden on this issue.
