FEMA Under Fire from America First Legal for ‘Egregious’ Constitutional Violations

Claims of relief aid withheld from Trump supporters spark demands for accountability.

America First Legal (AFL) has launched an investigation into the Federal Emergency Management Agency (FEMA) after reports emerged that disaster relief workers were instructed to avoid homes displaying Trump signs or flags. The conservative legal group, citing First Amendment violations, has filed a Freedom of Information Act (FOIA) request and demanded a full investigation into what they call a shocking act of political discrimination.

The incident centers on former FEMA supervisor Marn’i Washington, who allegedly directed relief workers in Lake Placid, Florida, to bypass homes advertising support for Donald Trump. AFL claims this represents a broader pattern of unconstitutional behavior, with similar allegations surfacing in Georgia and North Carolina.

According to AFL, at least 20 homes in Lake Placid were denied hurricane relief aid following Hurricanes Milton and Helene, solely because of Trump-related signage. AFL lawyer Will Scolinos called the actions “one of the most cruel, abusive, and egregious” violations of Americans’ constitutional rights, accusing FEMA of engaging in an illegal conspiracy to deprive citizens of aid based on their political beliefs.

“FEMA’s blanket refusal to provide aid to these homes, and even entire neighborhoods, based on the political speech in the yards of some but not all homes is not narrowly tailored to any compelling governmental interest,” Scolinos wrote in a letter requesting an investigation.

AFL’s FOIA request demands FEMA turn over communications involving Washington and any documents mentioning “Trump,” “Trump supporters,” or similar terms. The group has also called on Department of Homeland Security Inspector General Joseph Cuffari to conduct a formal probe into FEMA’s alleged misconduct.

The letter argues that FEMA’s actions violated the First Amendment by discriminating against individuals based on political affiliation. It further warns of the dangers of politicizing federal disaster relief, which could erode public trust in essential emergency services.

FEMA Administrator Deanne Criswell has labeled the incident in Lake Placid an “isolated incident” and said she has asked the inspector general to conduct an independent investigation. However, AFL and other critics are skeptical, noting reports of similar discriminatory practices in other states.

The inspector general’s office has so far declined to comment on the situation, citing standard protocol for potential investigations.

The AFL investigation has sparked widespread outrage among conservatives, who view the incident as part of a broader pattern of bias within federal agencies. “For four years, the Deep State has waged war on Americans’ freedom of speech,” Scolinos stated. “AFL will work tirelessly for accountability and to safeguard Americans’ constitutional rights.”

The legal group has demanded assurances that federal disaster relief will be administered fairly, regardless of political affiliation, and warned that any politicization of FEMA’s operations represents a grave threat to the agency’s credibility.

As the AFL investigation unfolds, the focus now shifts to FEMA’s internal processes and whether this incident signals systemic issues within the agency.
