In a bold legal move, sixteen Republican-led states have filed a lawsuit against the Biden-Harris administration, challenging a controversial plan to grant what critics are calling "immediate executive amnesty" to as many as 1.3 million illegal immigrants. The lawsuit, which was filed on Friday in partnership with America First Legal, targets a new parole-in-place program from the Department of Homeland Security that effectively offers a pathway to citizenship for over a million illegal aliens.
The states argue that the administration's program blatantly violates longstanding federal laws designed to prevent illegal immigrants from obtaining immigration benefits, such as lawful permanent resident status, without first leaving the United States. The lawsuit underscores the Biden administration’s disregard for these legal requirements, contending that the new program unconstitutionally grants amnesty to unvetted individuals who initially broke U.S. laws upon entering the country.
Illegal Immigration Surge: Since President Biden took office, over 10 million people have crossed the U.S. southern border, with 1.7 million illegal immigrant gotaways recorded, exacerbating an already critical border crisis.
Legal Repercussions: The lawsuit challenges the legality of the parole program, arguing it circumvents the legal immigration process and worsens the ongoing immigration disaster.
State Pushback: The sixteen states leading the charge include Texas, Florida, Georgia, and others, collectively seeking to block the administration's unlawful executive actions.
Texas Attorney General Ken Paxton, one of the primary voices in the lawsuit, minced no words in his criticism of the administration's actions. "Biden’s new parole workaround unilaterally grants the opportunity for citizenship to unvetted aliens whose first act on American soil was to break our laws," Paxton said. "This violates the Constitution and actively worsens the illegal immigration disaster that is hurting Texas and our country."
