Texas Sues Harris County for Funding Migrant Deportation Defense

AG Ken Paxton blasts $1.3M legal aid program as unconstitutional, says it's time to stop subsidizing lawlessness.

Texas Attorney General Ken Paxton is taking Harris County to court for what he calls a blatant misuse of taxpayer funds specifically, $1.3 million handed over to far-left organizations helping illegal immigrants fight deportation.

In a fiery statement, Paxton didn’t mince words:

“This is not just unconstitutional it’s evil and wicked. Millions upon millions of illegals invaded America during the last administration, and they must be sent back to where they came from.”

At the heart of the lawsuit is the Immigrant Legal Services Fund, created in 2020 and funded entirely by local taxpayers. The program funnels money to five pro-migrant nonprofits, providing free legal representation to non-citizens facing deportation—many of whom entered the U.S. illegally. Last month, Harris County’s all-Democrat majority voted to approve another $1.3 million for the initiative.

  • The county includes Houston, a sanctuary stronghold that already leads the nation in ICE detainers.

  • Without legal aid, 90% of migrants are deported, but that number drops to just 5% when they receive attorneys, according to liberal county officials.

  • Paxton's lawsuit argues the county is unconstitutionally giving public money to private groups for non-public purposes, and he’s demanding the court block any future disbursements.

The response from local Democrats? Predictable. County Attorney Christian Menefee labeled the lawsuit a “cheap political stunt,” bizarrely accusing ICE of “terrorizing immigrant neighborhoods” and deporting U.S. citizens. He then pledged to fight the suit in court on your dime, of course.

Paxton’s legal challenge is part of a larger effort to restore the rule of law in Texas, where liberal counties like Harris have openly defied immigration enforcement for years. The lawsuit exposes the growing divide between conservative leadership defending legal immigration, and progressive bureaucrats weaponizing public funds to protect illegal entrants.

This isn’t about compassion. It’s about control.

The Left is using taxpayer dollars to build a shadow legal system that shields illegal immigrants from federal law, while law-abiding Texans foot the bill. And if you dare object, they’ll call you a bigot and accuse ICE of cruelty. Meanwhile, your schools are overcrowded, your hospitals are under strain, and your property taxes keep climbing.

This is the Democrat blueprint undermine federal immigration law, obstruct enforcement, and funnel public resources to people who have no legal right to be here.

Paxton’s suit sends a message: The days of soft-on-illegal-immigration policies in Texas are numbered.
