Obama-Appointed Judge Lets Alleged MS-13 Member Stay Home for the Holidays

In a move that perfectly captures how broken our justice and immigration systems have become, an Obama-appointed federal judge has ruled that Kilmar Abrego Garcia a man linked to the violent MS-13 gang can return home to spend the holidays with his family in Maryland, instead of being held accountable by federal authorities.

Judge Paula Xinis, a U.S. District Court judge, extended an order on Monday that blocks Immigration and Customs Enforcement (ICE) from re-detaining Abrego Garcia, who has illegally entered the United States, been accused of human smuggling, and has been tagged as an MS-13 gang member in multiple police reports.

This isn’t a case of mistaken identity or an innocent man caught in red tape. Let’s break down the facts:

• Abrego Garcia entered the U.S. illegally in 2011 and was deported in 2023 due to what officials call an “administrative error.”

• He was brought back into the country in June to face federal charges for human smuggling after police stopped him in Tennessee, where he was hauling eight passengers without luggage a suspected trafficking operation.

• He has been twice accused of domestic violence, with his own wife previously requesting protective orders against him.

• He was also identified as a member of MS-13, one of the most violent transnational gangs operating inside the U.S., responsible for countless brutal crimes.

And yet, Judge Xinis accused the Trump administration’s legal team of acting in “bad faith” and prioritized her suspicion of federal enforcement over the clear and present danger this man poses to the public.

“Mr. Abrego Garcia is gonna return to his home with his wife and his children... and he will be at home through Christmas and New Year,” his attorney said, celebrating the ruling alongside cheering supporters.

Welcome to Biden-era America, where Democrat lawmakers like Maryland Senator Chris Van Hollen are more concerned with visiting MS-13-linked detainees in El Salvador than defending American citizens from gang violence.

Let’s be honest: if the names were flipped, and this was a conservative judge releasing a right-wing defendant under similar allegations, the media would explode. But when it’s an alleged MS-13 member walking free with the help of a Democrat-appointed judge, the silence is deafening.

This is what the Left’s twisted idea of “compassion” looks like: criminals go free, and law-abiding Americans pay the price.

How many more dangerous individuals need to slip through the cracks before Democrats admit their policies are putting Americans at risk?
