Democrat Congresswoman Charged After ICE Facility Clash
Trump DOJ takes bold stand as McIver faces felonies for assaulting federal agents during chaotic immigration protest.

In a decisive move that sends a clear message across party lines, the Department of Justice on Monday announced criminal charges against Rep. LaMonica McIver (D-NJ) after a clash with federal agents at an ICE detention center in Newark.
McIver, a sitting member of the Homeland Security Committee, is accused of assaulting, impeding, and interfering with law enforcement officers during a chaotic protest visit to the Delaney Hall facility earlier this month. The confrontation, captured on federal body-cam footage, shows McIver and other Democrat lawmakers forcibly breaching the entrance alongside Newark’s leftist mayor, Ras Baraka who was also arrested but later had his charges dropped.
Acting U.S. Attorney Alina Habba didn’t mince words:
“It is my Constitutional obligation to ensure that our federal law enforcement is protected when executing their duties.”
Habba, who once served as legal counsel to President Trump, emphasized that while she respects congressional oversight, McIver’s behavior crossed a legal line.
Let’s be clear: this was no peaceful visit. DHS Secretary Kristi Noem confirmed that McIver “assaulted, resisted, and impeded law enforcement officers,” adding that “no one is above the law.” ICE officers reportedly endured physical resistance from multiple House Democrats during the confrontation.
While the Left predictably circled the wagons, claiming the charges are “political,” the facts say otherwise:
Body-cam footage confirms the altercation, with McIver and her colleagues “storming the gate,” according to DHS.
McIver refused multiple chances to resolve the matter quietly, forcing prosecutors to act.
Fox News reports the congresswoman faces several felony charges that could result in jail time.
Minority Leader Hakeem Jeffries and other Democrat leaders decried the charges as “morally bankrupt,” but that’s rich coming from a party that’s spent years defending lawlessness and undermining law enforcement from BLM riots to sanctuary cities.
McIver responded with a predictable victim narrative, claiming she was fulfilling “lawful oversight responsibilities.” But oversight doesn’t mean trespassing, resisting federal agents, or inciting chaos for political theater. And let’s not forget this all happened at a federal detention site during an ongoing crisis at the border.
As House Speaker Mike Johnson put it bluntly:
“The video doesn’t lie… It was wildly inappropriate for those members to do that and we’ll have to take appropriate action.”
And that action is already underway. House Republicans are moving to censure McIver and strip her of her committee assignments a long-overdue step toward restoring order in the People’s House.
Homeland Security Chairman Mark Green captured the national mood:
“Like most Americans, I am so tired of seeing those on the Left constantly get away with their lawless, criminal behavior… Under this administration, no matter how privileged you are, you will be subject to the rule of law.”
This isn’t just about one lawmaker throwing a tantrum at an ICE facility. It’s about whether elected officials believe they’re untouchable or if they’ll finally be held to the same standards as every other American.
