ICC Did Not Accuse Israel of Genocide, Top UN Judge Clarifies

Media misled the public former ICJ president sets record straight on Gaza genocide claims pushed by the left.

For months, the mainstream media and left-wing activist groups have pushed the narrative that Israel has been accused of genocide in Gaza by the International Criminal Court (ICC). But now, the former President of the International Court of Justice (ICJ) the principal judicial organ of the United Nations has come forward to set the record straight.

Judge Joan Donoghue, who issued the preliminary ruling in South Africa’s case against Israel, said plainly this week: "The court did not decide that the claim of genocide was plausible."

That’s right the ICC did not rule that Israel committed genocide, nor did it affirm South Africa’s accusations as plausible under international law.

Appearing on BBC’s “HARDtalk,” Donoghue corrected the false reporting and activist spin that’s been flooding the airwaves. When pressed by the host, she explained that the Court’s decision only confirmed that Palestinians have a plausible right to be protected from genocide, not that Israel plausibly committed it.

“It did not decide and this is something where I’m correcting what’s often said in the media it didn’t decide that the claim of genocide was plausible.” Judge Joan Donoghue.

This is a devastating blow to groups like Amnesty International and Human Rights Watch, who have been trying to label Israel’s military defense against Hamas as a “genocide” a claim built on political theater, not legal reality.

In fact, legal experts have long cautioned that genocide accusations require a very high threshold of intent: the specific intent to destroy, in whole or in part, a protected group. As the European Journal of International Law recently emphasized, intent to kill or harm individuals is not enough. The burden of proof for genocide is immense and Israel’s actions in Gaza don’t come close.

  • Israel has allowed humanitarian aid into Gaza, despite Hamas’s documented abuse of that aid for terror operations.

  • The IDF has warned civilians to evacuate combat zones, used Arabic media to communicate safe routes, and halted fire to open humanitarian corridors.

  • Israel has even delivered medical supplies and incubators to Gaza hospitals in the middle of combat operations.

  • Every strike is vetted to ensure military targets are being engaged, not civilians.

These are not the actions of a nation committing genocide they’re the actions of a military force confronting a terror organization that hides behind civilians while doing everything possible to protect innocent life.

And yet, major news outlets and radical NGOs continue to misrepresent the ICJ’s preliminary ruling not because the facts support their claims, but because they need the narrative of Israeli guilt to justify their ideological agenda.

Judge Donoghue’s comments should end the misinformation. But don’t expect the activists or legacy media to backtrack anytime soon they’re too committed to the smear campaign.

Israel is not on trial for genocide. Hamas is in the court of human decency and truth.
