ICE Facility Incident Lands Democrat in Legal Trouble, Possible 17-Year Sentence
Rep. LaMonica McIver charged with assaulting federal officers during attempted obstruction of ICE arrest.

The lawlessness of today’s Democrat Party was on full display again this week as a federal grand jury indicted Rep. LaMonica McIver (D-NJ) for assaulting federal law enforcement officers during a chaotic confrontation outside an Immigration and Customs Enforcement (ICE) facility in Newark, New Jersey. If convicted, McIver could face up to 17 years in prison.
The indictment, announced Tuesday by interim U.S. Attorney Alina Habba, charges McIver with three counts of “forcibly impeding and interfering with federal law enforcement officers.” The charges stem from a May 9 incident where McIver and other New Jersey Democrats tried to forcibly interfere with ICE officers conducting an arrest at the Delaney Hall detention facility.
Despite the clear evidence captured on ICE body-cam footage, McIver maintains that she did nothing wrong and claims the charges are politically motivated.
“The facts of this case will prove I was simply doing my job and will expose these proceedings for what they are: a brazen attempt at political intimidation,” McIver claimed, attempting to portray herself as the victim.
The Department of Justice, however, outlined a very different version of events. According to the indictment, McIver and her fellow Democrats demanded entry into the secured facility under the guise of conducting "oversight." When ICE agents moved to arrest the Mayor of Newark, who had entered a restricted area, McIver physically intervened.
Key details from the DOJ statement include:
McIver encircled the mayor with her arms in an attempt to block agents from completing the arrest.
She forcibly struck one law enforcement officer with her forearm, grabbed him, and used both forearms to strike a second officer.
The crowd shouted instructions to "circle the mayor," further escalating the confrontation.
U.S. Attorney Habba made it clear that political grandstanding will not shield elected officials from facing consequences for criminal behavior. “While people are free to express their views for or against particular policies, they must not do so in a manner that endangers law enforcement and the communities those officers serve,” Habba stated.
This latest indictment underscores the growing pattern of lawless behavior coming from today’s Democrat leadership:
Rather than respecting the rule of law, Democrats are increasingly using their elected positions to obstruct immigration enforcement.
Democrats continue to push for sanctuary policies that shield illegal immigrants and criminal aliens from federal authorities.
In 2023 alone, ICE arrested over 170,000 illegal immigrants with prior criminal convictions many of whom would be protected under the Left’s sanctuary policies.
While the Biden administration has spent years attacking ICE and weakening immigration enforcement, President Trump and his administration have consistently supported federal agents on the front lines, ensuring they can carry out their duties without political interference.
This indictment of McIver serves as a stark reminder that no one not even elected officials is above the law when it comes to obstructing federal agents and endangering public safety.
