Judge May Release Hundreds of Illegal Immigrants Arrested in Chicago

In yet another stunning display of judicial activism over national security, a federal judge in Illinois is now considering whether to release hundreds of illegal immigrants arrested during recent ICE raids in Chicago a move that would further weaken already collapsing immigration enforcement under the Biden administration.

U.S. District Judge Jeffrey Cummings is expected to hold a hearing this week that could force ICE to set these individuals free with ankle monitors or similar tracking devices despite the fact that many were arrested lawfully and are in the country illegally.

At the center of this legal drama is a consent decree that immigration activists claim was violated when ICE conducted warrantless arrests in Chicago. The National Immigrant Justice Center, a progressive legal group, is arguing that these apprehensions breached the agreement by not establishing proper probable cause and risk of flight.

Last month, Cummings sided with the activists, ruling that ICE violated the decree even though federal law permits warrantless arrests in immigration enforcement when probable cause exists, a standard practice used nationwide.

One of the individuals ICE may be forced to release is Diana Patricia Santillana Galeano, an illegal alien from Colombia who caused chaos in Chicago when she fled a traffic stop and ran into a daycare to evade ICE agents. The incident sparked outrage after Rep. Mike Quigley (D-IL) falsely accused ICE of targeting a preschool teacher and storming into a childcare facility "without a warrant."

But the Department of Homeland Security quickly set the record straight:

“ICE law enforcement did NOT target a daycare and were only at this location because the female illegal alien fled inside,” DHS posted on X.

Galeano, who illegally crossed the U.S. border in 2023, had her children smuggled in just last month. When apprehended, she attempted to lie about her identity and denied knowing the man she was with despite evidence that they arrived together.

And now, a federal judge might send her and hundreds of others back onto the streets?

This is what Biden’s America looks like:

• Federal agents doing their job are undermined by activist judges.

• Violent or dishonest illegal aliens are coddled and released with little more than a GPS bracelet.

• Democrat politicians spread lies about law enforcement to score political points.

ICE arrests dropped drastically in Biden’s first two years in office, and the agency is now routinely hamstrung by red tape and courtroom interference. At the same time, over 10 million illegal immigrants are estimated to be in the U.S. a crisis made worse by decisions like the one currently under consideration in Chicago.

If this judge proceeds to release these individuals, it won’t just be a setback for ICE it will be a signal to the world: Come illegally, and the courts will protect you.

Meanwhile, Americans pay the price with strained schools, rising crime, and a justice system more focused on shielding lawbreakers than protecting law-abiding citizens.
